Thomas Massie has already said this on Twitter Bird: If “the pandemic is over” as Biden says, then all of the President’s emergency powers predicated on a pandemic, all COVID vax mandates, the emergency powers of every governor, Emergency Use Authorizations, and the PREP act should all be voided tomorrow.
They're idiots if they don't think EVERYONE will use this as an answer to mandates, and justly so.
The defense, of course, is that a statement by Brandon that "X is over" is neither a legally binding nor technically meaningful statement, but that would involve openly admitting that a President's statements in a public address carry no actual weight.
