according to OSHA this has always been true. they have all kinds of rules about wearing masks and respirators at work. i suspect this is why they were so rapidly sidelined in 2020. cost benefit analysis was simply not going to be allowed.

I heard a story about OSHA requiring non-slip surfaces in a meat packing facility and the agriculture department requiring a smooth floor for cleaning and sanitation. The plant went to court and the judge said, you must obey both requirements. The plant found a solution with a removable non-slip mat on a smooth floor.
So you can’t sue big pharma but you can sue big business if you suffer an adverse event due to a mandated vaccine. Here’s hoping that some big tech company mandates it and an employee sues them and makes millions.
Big tech wouldn’t care; millions is pocket change they’ll never miss. The only way this ends up hurting at all is either by destroying the mandating companies in the court of public opinion and/or possibly by emptying the pocketbooks of lots of the medium-sized guys. Since neither of those end will bring down the unelected bureaucrats who’ll gleefully do it all over again, I fear no one will end up winning in this dumb game.

Watching the airline industry force masks on its employees, wondering if OSHA will eventually come to their rescue, or tell the airlines that any adverse affects will be the company’s fault.
Pilots are not required to wear masks during flight due to the precious seconds it would take to remove the mask then put on a quick-don oxygen mask in case of a rapid decompression, but the powers that be still seem to think wearing a mask doesn’t decrease oxygen for other employees
Well that's a relief. But plenty of other folks carrying passengers are: bus drivers, Uber drivers, etc. I wonder who will come to the rescue of those passengers.

However it is not clear to me that this would apply to private actors (employers) as well as to govt. entities:
