28 is too many states for Biden to get this plan through, whether the courts reject it or not.

And even in the blue states that are supposedly going along, there will be huge pockets of rural red resistance. Enforcement will end up being big blue cities slowly choking themselves to death.

Honestly, I know it sounds crazy, but: see California. Though it gets a bad rap, there's lots of rural red there. And the rural red tend to be the producers of practical goods: the farms, the manufacturers, the laborers, the ones who make all the things the elite depend on. Rile them up, they will stop providing services to those that think they are the masters.

I mean, look at the Gavin Newsom recall! It's not even those that are Republican/red! No one thought the recall would get enough signatures to qualify, but here it is, a legit vote and neck-and-neck! Red/Blue/Yellow//Green/Purple/whatever your political persuasion - many, many people are pissed off at the CA leadership & taking strides to make a difference!

It's the same exact thing here in Washington. The giant blue cities dominate the political map but the red parts of the state dominate the geographic map. And those blue city voters are 100% dependent on the farmers in the red places.
